Baldwin & Clarke Retirement Plan Services, Inc., like all providers of financial services, is now required by law (i.e., the Gramm-Leach-Bliley Act of 1999 or “GLBA”) to inform our non-business individual clients of their policies regarding privacy of client information. As a Third Party Administrative Consulting Firm for retirement plans, we maintain professional standards of confidentiality. Therefore, we have always protected your right to privacy.
We collect nonpublic personal information about your business that is provided to us by you or obtained by us with your authorization. Generally, this information is not subject to the provisions of GLBA since it is financial information relating to a business entity. However, in limited circumstances, we may collect information during the performance of our services, e.g., a valuation for plan participants which may fall within the scope of GLBA’s disclosure rules and related rules promulgated by the U.S. Securities and Exchange Commission, the U.S. Federal Trade Commission, and the National Association of Securities Dealers, Inc.
For current and former clients, we do not disclose any nonpublic personal information obtained in the course of our practice except as required or permitted by law. Permitted disclosures include, for instance, providing information to our employees, consultants, or agents, and in limited situations, to unrelated third parties who need to know that information to assist us in providing services to you. In all such situations, we stress the confidential nature of information being shared. In those limited situations, we also require such third parties to execute nondisclosure and confidentiality agreements for your benefit unless you direct us to not do so.
We retain records relating to professional services that we provide so that we are better able to assist you with your professional needs and, in some cases, to comply with professional or regulatory guidelines. In order to guard your nonpublic personal information, we maintain physical, electronic, and procedural safeguards that comply with our regulatory or professional standards.
